Hunter’s Pardon: The Right Thing To Do & The Wrong Place To Stop

Joe Biden changed his mind for a reason. Is this a sign or a death rattle?

Joe Biden pardoned his son Hunter after an infamously aggressive prosecution that was literally unique in many ways. The Special Counsel David Weiss, left there by Biden after serving in the Trump administration, and appointed by Merrick Garland, went so far out of the bounds of normal conduct in these kinds of cases, that it was an absolutely justified pardon. Hunter is clean, sober, paid up on his taxes, and making amends. No DA would have brought this case. None.

Here is the statement from the White House:

Today, I signed a pardon for my son Hunter. From the day I took office, I said I would not interfere with the Justice Department’s decision-making, and I kept my word even as I have watched my son being selectively, and unfairly, prosecuted. Without aggravating factors like use in a crime, multiple purchases, or buying a weapon as a straw purchaser, people are almost never brought to trial on felony charges solely for how they filled out a gun form. Those who were late paying their taxes because of serious addictions, but paid them back subsequently with interest and penalties, are typically given non-criminal resolutions. It is clear that Hunter was treated differently.

The charges in his cases came about only after several of my political opponents in Congress instigated them to attack me and oppose my election. Then, a carefully negotiated plea deal, agreed to by the Department of Justice, unraveled in the court room – with a number of my political opponents in Congress taking credit for bringing political pressure on the process. Had the plea deal held, it would have been a fair, reasonable resolution of Hunter’s cases.

No reasonable person who looks at the facts of Hunter’s cases can reach any other conclusion than Hunter was singled out only because he is my son – and that is wrong. There has been an effort to break Hunter – who has been five and a half years sober, even in the face of unrelenting attacks and selective prosecution. In trying to break Hunter, they’ve tried to break me – and there’s no reason to believe it will stop here. Enough is enough.

For my entire career I have followed a simple principle: just tell the American people the truth. They’ll be fair-minded. Here’s the truth: I believe in the justice system, but as I have wrestled with this, I also believe raw politics has infected this process and it led to a miscarriage of justice – and once I made this decision this weekend, there was no sense in delaying it further. I hope Americans will understand why a father and a President would come to this decision.

This statement by itself is true, fair and just. However, if this, and some other performative pardons, are all Biden does in his last 7 weeks as the President to protect American citizens from the impending regime, it will be a sign of weakness and a stain on his presidency — already marred by the complete failure of the justice system under his watch. Traitors like Mike Flynn and Roger Stone were allowed to continue to commit crimes. These pardons were given before they conspired to execute J6.

Biden made this decision right after Trump nominated Kash Patel, the Flynn/QAnon dudebro that is attempting to sue me, as FBI Director. There’s a reason for his flip flop and Biden needs to be honest about it. He now knows people will be persecuted in this next administration. He knows people like me and my friends are being hung out to dry — just waiting for Trump’s Reich to abuse power.

So the question is, does this new understanding of the seriousness and radical nature of the incoming regime mean that Biden is going to start using the power the American people gave him to protect the rest of us? Or will this be the final surrender?

I’ve written numerous articles with specific actions the President could have taken along the way to prevent this exact scenario. They range from Lincoln-esque actions like using the 14th Amendment to disqualify Trump from taking office, declaring Russia a terrorist state, nationalizing Elon Musk’s companies, expanding the Court, taking control of the feckless DOJ and FBI, and ordering a forensic recount of the election. Nevertheless, none of has happened, or seems to be under consideration.

If Joe Biden has newly realized that he is handing power to a violent transnational kleptocracy funded by fascist oligarchs that will abuse the government to persecute Americans, has he reconsidered whether this is really a “peaceful transfer” after all? Unfortunately, I have my doubts.
